In the 2020s, the CBD oil and related cannabis/hemp industries are set to blow up in the United States, with an exponential increase in such products expected to flood the market as a natural, inexpensive and more efficacious medicine for many ailments; Americans are finally gaining access to these alternatives to the drugs and curatives that big pharma companies are pushing.

The problem, naturally, is in the politics. Due to an overwhelming emphasis on state-level regulation- and lawmaking, the US will likely never have uniform distribution of CBD products. And recent changes on the federal level such as the 2018 Farm Bill may help but cannot completely alleviate the problem.

State laws on the import, transport, distribution and sale tend to hold back access to cannabidiol (CBD) oil and CBD oil products – despite even the Agriculture Improvement Act of 2018 making the production and sale of CBD oil products legal federally. Section 10111 of what was originally called the 2018 Fam Bill legal “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, cannabinoids, isomers, acids, salts, and salts 1of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol [a.k.a. THC] concentration of not more than 0.3%  on a dry weight basis.”

Agriculture Improvement Act notwithstanding, as of this writing, CBD oil products nevertheless may not be found anywhere in the states of Alabama, Idaho, Kansas, Kentucky, South Carolina, South Dakota, Tennessee, Wisconsin and Wyoming. And in five states, CBD products may be bought only with a medical prescription: This goes in Georgia, Indiana, Iowa, Texas and Virginia.

But the most important aspect to remember about US laws on CBD oil is that they’re pretty much infinitely malleable. Any day in any state the law could change and patients could wake up to a completely different legal situation with regard to CBD. Just to cite one example, New Mexico lawmakers hurried through a bill in 2018 which forced dispensaries to switch to only in-state producers within just a few months.
